The North Gauteng depot at Wolmerton in Pretoria has been in operation for some time. There are a number of functions to support the new trains that are already in service in the province: in addition to its contract with the Passenger Rail Agency of South Africa (PRASA) for the supply of 600 new commuter trains over 10 years, Gibela has entered into a 19-year technical support and savings supply agreement (TSSSA) with the Agency. A Section 54 agreement also includes an agreement for technical assistance and the supply of spare parts for category 377 vehicles, which also expires on 7 March 2022. There are currently two contracts with the Gibela Rail Transport Consortium (Gibela): ■ Manufacture Supply Agreement (MSA) – 600 new trains with an order value of R59 billion over a delivery period of 15 years; and■ Technical Support and Spares Supply Agreement (TSSSA) – Agreement to maintain new trains over a period of 19 years. Since an operator typically uses a TSSSA to support their scooter maintenance, it is customary for the operator (and not the supplier, unlike a TSA) to be required to maintain the rolling stock in accordance with applicable laws and standards, vehicle manuals and an agreed maintenance plan. As part of this agreement, Gibela will provide, as the name suggests, maintenance and technical assistance as well as spare parts for the new trains. As an alternative to the maintenance of vehicles maintained by a maintenance service provider under a rail traffic agreement (TSA), an operator may choose to maintain the rolling stock itself or to ensure that a third party holds it under an existing maintenance contract. If the operator chooses to maintain the vehicles himself, he may request technical assistance determined by the original manufacturer of the roller or another supplier for the performance of this maintenance. Under these conditions, the operator may choose to conclude a technical support and spare parts contract (TSSSA). This practice note describes the essential provisions of a typical TSSSA.
